1. Who we are and what we provide

Nelamy is a technology platform that lets people in Pakistan browse, bid on, and buy items listed by independent sellers, and lets sellers list items for auction and/or Buy Now.

What Nelamy sells to vendors is membership — access to listing tools, store features, and listing quota. Nelamy is not the buyer or seller of listed goods; not a retailer, warehouse, courier, or escrow agent; not a bank; and not a party to the contract of sale between buyer and seller.

Nelamy does not collect payment for products. Product money is paid directly by the buyer to the seller (for example JazzCash, Easypaisa, bank transfer, or cash on delivery) on terms those two users agree.

Nelamy’s charge to sellers is the membership / subscription fee described below, not a commission on each sale, unless we later publish a different fee and you accept it.

3. Eligibility

You must be 18 years or older and able to enter a contract under the laws of Pakistan. You must give true, current information. One person or business should not keep multiple accounts to evade limits, suspension, or fees.

4. Accounts

You are responsible for your login details and for all activity on your account. Notify us at once if you think it has been misused.

We may refuse, suspend, or close an account where we reasonably believe there is fraud, abuse, illegal activity, unpaid membership where required, or a breach of these Terms.

5. Buyers (free)

Creating an account, browsing, searching, bidding, messaging a seller, and using Buy Now does not require a Nelamy membership fee.

By bidding or confirming Buy Now you confirm that:

• the bid or purchase is genuine;
• you can pay the seller the amount due;
• you will complete payment and collection or delivery as agreed with the seller if you win or buy.

Bids are binding. You cannot cancel a bid merely because you changed your mind. Fake bidding, shill bidding, or collusion is prohibited.

Winning an auction or confirming Buy Now creates a contract between you and the seller, not with Nelamy. Nelamy may notify both parties and show the seller’s payment methods. That is a convenience only; it does not make Nelamy the seller or the payment collector.

6. Vendor membership (what Nelamy charges)

Sellers access listing tools under a membership model.

6.1 Free starter

Your first product listing may be created without a paid plan, subject to store and listing review. After that, further live listings require an active paid membership, unless we state otherwise.

Paid membership is billed monthly in advance. Current plans (which we may change with notice on the Platform) are:

6.3 What the fee covers

The fee is for Platform access: listing quota, vendor dashboard features included in that plan, and related tools. It is not a payment for goods sold, not a holding of buyer funds, and not a guarantee that items will sell.

6.4 How you pay Nelamy

Membership is paid to Nelamy by the methods we publish (currently JazzCash / Easypaisa and bank transfer, and any online gateway we later enable). You must use the published account details and send any required receipt or reference so we can activate the plan.

6.5 Activation, term, renewal, expiry

Membership starts when we confirm payment and activate the plan, or when an automated gateway confirms it. The usual term is 30 days. If it is not renewed before expiry, listing rights may be reduced to the free tier or listings may be held until you renew. We may notify you before expiry; it remains your duty to renew.

6.6 No sale, no refund

Membership fees are for access, not for results. If an item does not sell, that is not grounds for a membership refund. Full membership refund rules are in our Refund Policy.

6.7 Changes to plans and prices

We may change plan names, prices, or quotas. Changes apply from the next renewal or from a date we publish. They do not rewrite a period already paid, unless the law requires it.

7. Store verification and listing approval

A public store may require an application (including identity and contact details such as CNIC and WhatsApp). We may approve, reject, or ask for more information.

Listings are typically reviewed before they go live. Approval is not a certificate of quality, legality, or authenticity. We may refuse, delay, unpublish, or remove a listing at any time for policy, legal, or operational reasons.

8. Listings, auctions, and Buy Now

Sellers must:

• own the item or have the right to sell it;
• describe it honestly, including defects;
• use their own photos where required;
• set a lawful price, starting bid, increment, and optional reserve;
• state how buyers should pay the seller (not Nelamy);
• pack, ship, or allow collection as agreed.

Auction timers start according to Platform rules (including after approval). A seller may end an auction early only where the Platform allows it. If a reserve is not met, there is no sale unless the seller and Platform rules say otherwise. Auto-relist, where enabled, is a convenience and not a guarantee of sale.

Where Buy Now is available, the first valid confirmation under Platform rules secures the item, subject to seller performance.

9. Product payments (buyer pays seller)

Nelamy does not receive, hold, or guarantee product payments. The buyer pays the seller using the methods the seller offers. Disputes about non-payment, short payment, fake receipts, or chargebacks are between buyer and seller. We may, but are not obliged to, help them communicate or suspend accounts involved in abuse.

If we later offer an optional payment link or gateway, that is still only a way to pay the amount due under the membership or, if clearly labelled, under a product order. Unless we expressly state that we are the merchant of record (we are not, for products), the sale remains between buyer and seller.

10. Shipping, collection, and risk

Delivery, pickup, packaging, courier choice, cost, and timing are agreed between buyer and seller. Risk in the goods passes according to that agreement and applicable law. Nelamy is not liable for delay, loss, damage in transit, or failed collection.

11. Product returns and membership refunds

Returns, refunds, replacements, and warranties for goods are the seller’s responsibility, subject to the listing, the seller’s policy, and Pakistani consumer law where it applies.

Nelamy does not operate a money-back guarantee for products. Membership fee refunds (if any) are governed by the Refund Policy.

12. Prohibited items and conduct

You must not list or transact in anything illegal under Pakistani law or these policies, including without limitation: narcotics, weapons and explosives, stolen or counterfeit goods, pornography, wildlife prohibited by law, fake currency, government identity documents, dangerous chemicals, malware, or items that infringe intellectual property.

You must not harass others; post hate speech or misleading content; scrape the Platform; interfere with security; evade fees; or use the Platform for fraud.

We may remove content, void bids, cancel listings, hold stores, and report matters to authorities.

13. Your content

You keep ownership of photos and text you upload. You grant Nelamy a non-exclusive, worldwide, royalty-free licence to host, display, and promote that content in order to operate and market the Platform. You confirm you have the rights to grant this licence.

14. Nelamy intellectual property

The Nelamy name, logo, design, software, and Platform content (other than user listings) belong to Nelamy. You may not copy or exploit them without written permission.

15. Privacy

We may process account, listing, and communication data to run the Platform. Details are in the Privacy Policy, which is a notice only and does not create extra duties on Nelamy beyond mandatory Pakistani law. Do not submit other people’s personal data unless you are allowed to.

16. Disclaimer

The Platform is provided “as is”. We do not warrant uninterrupted or error-free service, that listings are accurate, or that buyers or sellers will perform.

We do not inspect, test, or guarantee products. Any verified store or approved listing means only that we ran our internal checks, not that the goods are genuine or the seller is creditworthy.

17. Limitation of liability

To the fullest extent permitted by Pakistani law:

• Nelamy is not liable for product quality, delivery, or buyer–seller payment disputes;
• Nelamy is not liable for lost profits, lost data, or indirect or consequential loss;
• Nelamy’s total liability to you for membership or Platform use in any period is limited to the membership fees you actually paid us in the three (3) months before the claim.

Nothing in these Terms excludes liability that cannot be excluded by law (including fraud).

18. Indemnity

You will indemnify Nelamy and its officers and staff against claims, losses, and reasonable legal costs arising from your listings, your product transactions, your membership use, your content, or your breach of these Terms or of the law.

19. Suspension and termination

We may suspend listings, stores, membership benefits, or accounts for breach, non-payment of membership, legal risk, or operational need. You may stop using the Platform at any time. Unused membership time is not refundable except as set out in the Refund Policy.

On closure we may remove listings. We may keep records as required by law or for dispute handling.

20. Changes to these Terms

We may update these Terms by posting them on the Platform. The new version applies from the stated effective date. Continued use after that date is acceptance. For a material change to paid membership, we will give reasonable notice where practicable.

21. Governing law

These Terms are governed by the laws of the Islamic Republic of Pakistan. Courts at Islamabad have exclusive jurisdiction, unless a mandatory law says otherwise.
